Divorce, Marital Finances and Clean Break

 

Fees from £80 per hour

 

  • Assistance is offered in applying for financial aid (Help With Fees) to cover court application fees related to divorce proceedings. 
  • This includes support with the Divorce Application, defending a Divorce Application, applications concerning matrimonial finances and the division of assets, as well as any other associated matrimonial proceedings. Please note, this service is only available if you are on a low income and is not the same as Legal Aid. 
  • Guidance and support are provided in preparing and completing the Divorce Application, responding to the Acknowledgement of Service Form, and applying for both the Conditional Order (formerly known as Decree Nisi) and the Final Order (formerly Decree Absolute). 
  • Assistance with completing Form D11, which may be used to request service by email, instruct a Bailiff to serve documents, or to apply for the Final Order if twelve months have passed since the Conditional Order was granted. 
  • Form D89, Deemed or Alternative Service
  • D11 for asking the Conditional Order to remain in place if the Final Order has not been applied for after a year

  • Guidance regarding the division of pets as part of the separation process. 
  • Assistance with applying for a Freezing Order to prevent the disposal of assets.

Attending Court

  • Accompanying you to court, providing support and guidance throughout the process. 
  • Permission to quietly advise and speak to you during proceedings. 
  • Assistance with understanding court procedures and legal terminology. 
  • Help with drafting questions to ask during the hearing. 
  • Preparation of opening and closing statements for your case. 
  • Engaging in pre-court negotiations with the other party, including meetings with their barrister or solicitor. 
  • Assistance in building and structuring your case for court. 
  • Help with preparing your court bundle, ensuring all necessary documents are included. 
  • Support in managing and preparing for cross-examinations.
