What is a McKenzie Friend?

 

The role of the ‘McKenzie Friend’ was created following the 1970 case McKenzie v. McKenzie.

 

A ‘McKenzie Friend’ does not need to be legally qualified; I myself, however, have a Law Degree and, in addition, am part qualified as a Barrister.

 

What sets me apart from a non professional McKenzie Friend is that because of my legal qualifications I can charge for my services and in court I am by courtesy of the CPR allowed to quietly advise my client in court, advise what questions to ask and the judge can give me ‘Rights of Audience’, ask me what my view is, ask me to negotiate between the parties and even Ask me to write the Order to be submitted before the Judge. A friend or relative or anyone else who is only a McKenzie Friend and not a professional one, cannot do any of the above.

 

I am recognised by the Judges throughout the South West and have been commended by all. I am now, because of my reputation, being asked my opinion, being asked to arrange Drugs Tests, write Orders, Negotiate between parties and  whether the case should be adjourned etc. 

 

 

   

  

 

How can a McKenzie Friend help?

 

What a Professional McKenzie Friend May Do:

 

  • Advise on any matter to do with Family Law, Divorce & Matrimonial Law, Separation.
  • Assist in the preparation of all Divorce and Family forms.
  • Assist in the preparation of all Small Claim Forms
  • Write a Pre Action Letter
  • Assist in writing Position Statements and Witness Statements
  • Participate in negotiations
  • Assist in preparing the court bundle
  • Discuss and go through case notes and prepare for the court appearance.
  • Attend court
  • Provide moral support for the LIP
  • Take notes in court
  • Quietly advise on Points of Law or Procedure and Issues that the litigant may wish to raise in court
  • Prepare Questions the litigant may wish to ask witnesses
  • Prepare opening and closing statements
    The list is endless
